AI Incident Response in Local Government: A Practical Guide to Continuity and Notification

Why plan an AI incident response

AI systems are already part of critical processes in many local governments: case evaluation, request classification, customer service chatbots, resource prioritization, etc. An incident — from a loss of availability to an unexpected bias or a data leak — can directly affect citizens’ rights, administrative continuity and public trust.

Beyond operational best practices, there are regulatory obligations: the ENS (Royal Decree 311/2022) requires security and continuity measures; the GDPR requires notification of personal data breaches to the Spanish Data Protection Agency (AEPD) within defined timeframes; and the EU AI Act introduces post-market monitoring and reporting duties for high-risk systems. An effective response is therefore not optional: it is a technical, legal and reputational requirement.

Operational principles for an AI incident response plan

  • Clear responsibilities: define roles (model owner, data team, CISO, DPO, legal, communications).
  • Regulatory alignment: mechanisms to comply with ENS, GDPR and the EU AI Act depending on the incident type.
  • Impact minimization: technical and operational containment to reduce harm to users and preserve service continuity.
  • Recording and learning: full traceability of the incident and documented corrective actions.

Phases of the response cycle (with practical actions)

1. Preparation

  • Minimum inventory: keep an up-to-date record of deployed models (model, version, training data, owner, environment).
  • Define SLAs and criticality levels: classify systems by impact (e.g., high: automated decisions affecting rights; medium/low).
  • Contingency plans by type: degrade to manual processes, block deployment to production, or switch to a previous version.
  • Tools: enable centralized logging, store input/output data (retention controlled by GDPR), and set up SIEM alerts.

2. Detection

  • Proactive alerts: monitor performance metrics, data drift, error rates and fairness signals.
  • Reporting channels: establish an internal inbox and procedures so staff and citizens can report problems.
  • Rapid verification: define a technical checklist to determine scope (availability, data integrity, bias, leakage).

3. Assessment and containment

  • Controlled restoration: return to service only after technical and legal validation; use staging environments for tests.
  • Technical review: root cause analysis including review of data, model and deployment processes (CI/CD).
  • Corrective measures: retrain with representative data, adjust thresholds, strengthen access controls, run fairness tests.
  • Documentation: update the inventory, playbooks and staff training based on lessons learned.
